Michigan’s Halt on Residential Construction Allows Only Temporary Security and Weatherization Measures

What is Currently Allowed
Governor Whitmer has offered some clarification on what residential construction activities are allowed.

• Work strictly necessary to protect the current condition of the project such as temporary security and weatherization measures

• All other in-person work on the project must cease during the time the Governor’s

Executive Order designates Builders are responsible for determining which minimum and temporary actions to take for security and weatherization.

Builders need to be able to justify their decisions if questions are raised or if there are disputes about the necessity of the proceedings. Do not push beyond the allowed minimum and temporary measures.

Clarification on Federal vs. State Restrictions
Beware of the false rumor that federal government has overturned Michigan’s restrictions to the building industry. It has not. The orders from Michigan’s Governor must be followed. Refer to the clarification below about the intersection of federal and state compliance.

The confusion may have stemmed from a new advisory memo on Saturday, March 28th, from the Cybersecurity and Infrastructure Security Agency (CISA) that outlined broader services and production that that could remain active in some areas of the country. It does not require Governor Whitmer to allow home building as an “essential” industry to ensure public health at this time in the state of Michigan. According to the memo "This list is advisory in nature. It is not, nor should it be considered, a federal directive or standard... Individual jurisdictions should add or subtract essential workforce categories based on their own requirements and discretion."
