3-24-2020 – Governor’s Order: Home Repairs & Construction

Monday’s Executive Order (EO) from Michigan’s Governor is a “Temporary requirement to suspend activities that are not necessary to sustain or protect life.” This has raised questions regarding how residential construction is effected. This update pertains to the specific question of home repairs. 

According to the Michigan.gov/coronavirus Frequently Asked Questions page:“Q: Are people who repair homes considered critical infrastructure employees for the purposes of Executive Order 2020-21?
In general, yes. Under the order, critical infrastructure workers include workers ‘who provide services that are necessary to maintaining the safety, sanitation, and essential operation of residences.’ To the extent your workers perform jobs that are necessary to the safety, sanitation, and operation of homes, they may be designated as critical infrastructure workers.”

The answer makes clear that home repairs and the workers doing home repairs are indeed critical infrastructure and critical infrastructure workers as outlined by the EO. For further clarity The Michigan Residential Code defines “repair” as the “reconstruction or renewal of any part of an existing building for the purpose of its maintenance or to correct damage.”
This language indicates new construction would not qualify for allowance under the order, including new remodeling projects. 

In-Progress Remodeling
In-progress remodeling projects may fit the requirement if finishing work is necessary to the safety, sanitation and essential operation of the house. Without more specific answers from the state, in our opinion, such work may be completed. We also hold the opinion that new work may begin if it corrects damage to a structure, as it relates to the safety, sanitation and essential operation of the house. Under this EO, starting a new kitchen or bathroom remodel does not qualify as necessary, and such work should be temporarily suspended.

In-Progress New Construction
The question remains if homes already under construction can be completed or if they can be “buttoned up” to provide safety.We will keep you informed as more information becomes available.
